Fiduciary Services

The Probate Code states that fees for a Professional Fiduciary serving in a fiduciary capacity must be "reasonable". The Probate Court has the authority to define the reasonableness of fees in the context of any particular case before the court. North Coast Fiduciary has used the Contra Costa County Superior Court Local Rules of Court as a guideline for determining our fee schedule. These local rules have defined fee ranges for both Professional Fiduciaries and Probate Attorneys.


Trust Administrations

Serving as the Trustee of a conventional trust or special needs trust. Conventional and special needs trusts manage the assets (cash, investments, real property, intellectual property, court/insurance settlements or awards, and other owned assets) that were placed in the trust by the grantor (owner of the assets).

A conventional trust has the primary purpose providing the ability to dictate the use of the trust’s assets by the Trustee, in the instance the grantor becomes incapacitated or dies. Special needs trust has the primary purpose of shielding the assets from consideration for the exclusion of government benefits for the beneficiary of the trust.

Estate Administrations

Estate Administration is a probate court proceeding that is initiated to determine the distribution of a decedent's assets according to the decedent's will.

In the absence of a will, asset distribution occurs based on probate law of intestate succession, which determines the distribution of assets hierarchy for the beneficiaries.

The executor is the person named in the decedent's will to distribute the non-trust assets. If there is no will or the executor of the will is unable or unwilling to serve, the probate court will appoint an administrator/personal representative to distribute the non-trust assets of the decedent.

Fiduciary Consulting Services

North Coast Fiduciary offers consulting services for non-professional fiduciaries serving in any of the following roles: trustees, estate administrators/executors, agents under power of attorney, and conservators. We can advise on executing their roles as the previously mentioned, but we are not licensed attorneys and advise you to always be represented by an attorney in your role as we always are in our professional capacity.

Conservatorship Administrations

A conservatorship is the result of a proceeding in the probate court where an individual is deemed to lack the capacity to manage their own financial affairs (assets and income) and/or to provide informed consent to their own medical care. If the court determines incapacity then the court appoints a conservator to act in the sole best interest of the conserved individual (conservatee).

The court retains the authority over and oversight of both the conservator and the conservatorship for the duration of the conservatorship. Conservatorships can be terminated by the court if the court deems the conservatee has regained capacity.

Agent Under Power of Attorney

A power of attorney (POA) is a document signed by a person that empowers another person to act as an agent in addition to that person, in matters of Finances or Health. The POA can outline immediate authority, or springing authority (the agent’s authority is only effective upon the conditions outlined in the POA, which often includes incapacity).

The scope of the financial agent’s authority (defined in a POA doc) can include managing investments, banking, receipt of payments, and contract execution.

The scope of the health agent’s authority (defined in a POA doc) can include managing care providers, making medical decisions, and selecting living environments.

Receiver

A person appointed as a custodian of a person or entity’s property, finances, general assets, or other business operations as it relates to a business. Receivers can be appointed by courts, government regulators, or private entities.
